Welcome to Manifested Digital Presence. These Terms of Service (“Terms”) govern your access to and use of our website, services, and any content, tools, or materials provided by us. By using our website or working with us, you agree to be bound by these Terms.

1. Who We Are

Manifested Digital Presence is a veteran- and minority-owned digital marketing and brand strategy agency based in Plano, TX. We offer web design, digital marketing services, branding and creative solutions, marketing strategy consultation, and analytics support to help businesses elevate their digital presence.

2. Use of Our Services

You agree to use our website and services in a lawful, respectful, and responsible manner. You must be 18 years or older to use our services. You may not use our site to distribute malware, spam, or other malicious or illegal materials.

3. Client Responsibilities

As a client, you agree to:

Provide accurate and timely information. Respond to communication requests during the course of your project. Abide by the payment terms outlined in your service agreement or invoice. Respect intellectual property and confidentiality terms as outlined in Section 6.

4. Payments & Refunds

All service fees are due according to the agreed-upon payment plan. Deposits are non-refundable unless otherwise stated in a written agreement. Custom services and digital products are not eligible for refunds once delivered, due to the nature of the work and time investment.

5. Scheduling & Cancellations

For coaching calls, consultations, or discovery sessions, we request a minimum of 24 hours’ notice for cancellations. If you miss or cancel a scheduled session without notice, you may forfeit that session or be charged a rescheduling fee.

6. Intellectual Property

All content, branding assets, and deliverables created by Manifested Digital Presence remain the intellectual property of our agency until payment is received in full. After full payment, ownership of custom materials (e.g., logos, websites, graphics) is transferred to the client unless otherwise stated.

You may not copy, reproduce, or repurpose any of our proprietary resources, visuals, or strategies without written consent.

7. Confidentiality

Any sensitive or proprietary information shared by either party during the course of a project will remain confidential. We will not disclose client details, strategies, or materials to third parties without permission.

8. Third-Party Tools & Integrations

We may recommend or integrate third-party tools (e.g., Canva, Go HighLevel, Zapier). We are not responsible for the performance, pricing changes, or policies of these tools. You agree to review and comply with their individual terms of use.

9. Disclaimer

We strive to provide accurate, strategic, and personalized services. However, results are not guaranteed and depend on various factors including market conditions, audience behavior, and implementation. By using our services, you acknowledge that outcomes such as website traffic, sales, or visibility may vary.

10. Limitation of Liability

Manifested Digital Presence is not liable for any indirect, incidental, or consequential damages arising from the use of our services or website. Our total liability for any claim arising out of your use of our services is limited to the amount paid to us for the services in question.

11. Modifications

We reserve the right to update these Terms at any time. We will post changes on this page, and your continued use of our services after any update signifies your acceptance of the revised Terms.
